I just skimmed the DOJ's brief, and I don't see Word One about Windows 98.

The basic relief requested by the United States in this case is an order requiring Microsoft to comply with the Final Judgment, stop compelling OEMs to license Internet Explorer 3.0, and not compel OEMs to license Internet Explorer 4.0 as a condition of licensing Windows 95.

Another point worth making: to the extent the judge's order applies to IE 4, it is merely preserving the status quo, if the DOJ's assertions that Microsoft does not presently compel OEMs to take IE 4 is true.
