04/03/2014 Minute Entry for proceedings held before Judge Dora Lizette Irizarry: Sentencing held on 4/3/2014 for Seymour Eisenberg (4). Appearances: AUSA Nathan Reilly; USPO John Lanigan by Patricia Sullivan; Defense attorney John Meringolo with Clara Kalhous for defendant (present/on bond). PSR amended. Defendant sentenced on counts 1, 3, and 5 of superseding indictment to FIVE YEARS of probation (concurrent on each count). Special conditions of probation: 1. Comply with restitution order; 2. Comply with forfeiture order; 3. Full financial disclosure; 4. Maintain lawful and verifiable employment; 5. May not possess firearm, ammunition, destructive device; 6. Mental health treatment including gambling counseling. $100 special assessment per count (total $300). Restitution (joint and several with codefendants Moskowitz and Tepfer): $3,082,056 to be paid at rate of 10% of gross monthly income; interest on restitution is waived. No fine due to priority of restitution. Defendant advised of right to appeal. Within 5 business days government to provide a proposed restitution order to be attached to the judgment.
