This story stinks from all directions of the compass..... First of all, it has nothing to do with Obama or Obamacare, it is strictly a Medicare case... I'll be happy to debate you line by line but you'll note that no major media outlet including Fox, carried the story....This is NY and the case took place in metropolitan NYC, newspapers, TV, radio should have been all over this.....there are no links. All references are RW blogs... The guy died when he did because of his stupid daughter and the physician(s) who did not admit him as an inpatient

From reviewing the information available, I think you're dead wrong here. The hospital could not dialyze him under Medicare Part A unless he was admitted. This, apparently, is a rule created by Obamacare. And he could not be admitted under the two-day rule.

the decision over whether Medicare covers it under A or B can be done and is usually done after the fact.

I have no idea where you got that notion but it bullshit. Total bullshit. Whether it is billable under A or B depends upon the nature of the services and the setting in which it is delivered, among other things. It isn't like the facility can just say, "Oh, we don't think Part A will cover this so we'll just bill it as a Part B claim."
