Neither of your opinions make much sense, when considered either in the normal meaning of the words of the amendment in the English language, or in the context of the history at and before the creation of the amendment. In Stevens case I suspect its a matter of having an opinion of the way he would like things to be and then trying to come up with some legal interpretation that moves things in that direction.
