The $100 million dollar question is how did the "accounting errors" get by the 1996 audit? If the action was deliberate, the legal liabilities are immense. In addition to the shareholders, you'll have the bondholders involved as well (latest class action alludes to this already). Also expect "Deceptive Trade Practice" suits by some of the larger investors.

It really shouldn't take too long to understand what happened. All you've got to do is have S3 turn over the invoices for the material which was counted as revenue which actually shipped into distribution. It'll be interesting to see the names of the customers printed on those invoices. There's a concrete paper trail out there.

As for the "January" effect, I take it that you are a short term player. What will you do in January if S3 announces the SEC is investigating?
