Ed, Excellent article. very timely. Here's an idea... it seems to me that this lottery question could be resolved quite easily with an experiment: Get two sample groups - one comprised of skilled poker players, and the other comprised of unskilled players.. then run an unbiased experiment. They could sanction some respectable research organization to conduct the expirement - perhaps researchers from one of the state universities. Even if the Court rules that video poker, in its present form, is equivalent to a lottery, the video poker machine designers could simply go back to the drawing board - producing a new generation of machines that more effectively rewarded skill.
