If the ruling goes against the White House, it’s hard to overstate the impact. Without subsidies, consumers in 34 states would face huge additional costs and, because of those costs, potential exemptions from the law. And voters – a substantial percentage of whom have never liked Obamacare – would be further alienated from the Democratic Party just in time for midterm elections.

It is absurd to suggest that this ruling will alienate voters from the Democratic Party, especially in light of recent polls that say that people are mostly happy with their coverage. There is an obvious easy fix to the law--simply make it clear that the subsidies also apply to the Federal exchange. The Republicans will refuse to do this. Then the Democrats simply tell people why they just lost affordable insurance. That should rally plenty of Democrats to come out to vote.

Of course, Democrats have been known to snatch defeat from the jaws of victory before, and this may be another time. I don't think so though. There are some tough races for Senate seats, but they have some good candidates running.
