It didn't "exclude" the subsidies. It was silent on them. There is a difference.

The people who wrote the Constitution back in 1787 made some embarrassing errors that no one noticed for years until they were tested. The way they elected Presidents and VPs, for example. It had to be corrected in the 12th amendment, not passed until 1803 and the problems of which weren't uncovered until the election of 1800.

Let's not pretend that most laws, especially complicated and/or controversial ones, don't have errors in them that need to be fixed after those errors are uncovered in practice over a period of years.
