Well, the way I understand it the ACA specifically mentioned subsidies from the "state" in a context that excluded the federal exchanges, but we will have to probably wait for more court decisions on this to see how the Justices feel about it.

I've read it and don't see how you can come to that conclusion. It more nearly supports the generic notion of the "state" as a government rather than the state as a geographical location. Admittedly, bad wording and a drafting error. But, in the hands of sensible judges, it would have been seen as such.

It is also the case that the full body of the legislation assumes the generic form of "state" in that sentence. And there is, apparently, no recorded comment that limited it to states as geographical location. More evidence the two DC circuit court judges were reaching. Will love to see what John Stewart and Colbert do with it.
