Not all "executive action" is a violation of the Constitution, and in Bush's case, it was generally related to the war which at least provides some basis for having done it. A lot of people have still claimed that Bush violated the Constitution.

In Bush's case it generally was not done as an end-around Congress. Obama is using it because his positions are so extreme and Reid won't bring any Republican legislation to a vote.

Big difference.
