The duty to warn assumes the duty for the state to protect is inoperable. It also implicates the victim in any associated crime. The cases presented did not clarify if the danger was clear and present or not. Assuming the state has done it's job, there should not be any assumed clear and present danger. If the stalker was known by the victim to be in violation of the state's terms, the duty falls on the victim to inform the state, then if someone is injured because the state did not rectify the problem, the liability falls back on the state.
