Ummmmmmmmmmm...

They usually take the loss unless the amount is very significant so that incident cost me nothing.

Fortunately for me, the cards that I have promise zero liability.

I would hope that Apple follows suit or at the very least the same protection for the card applies to when it is used in Apple Pay (I don't see why not).

Someone once intercepted a check for me and forged my signature in order to cash it.
The check was for decent amount - around $500 back when money was money and I didn't have any.
It was easy to prove:
They made the signature so beautiful and cursive that it would be obvious to a blind person that it was forged. My signature looks like a bird looking for seeds with a pen tied to it's broken, non dominant leg.
The guy had a friend in CHASE MANHATTAN BANK <- (emphasis on purpose) - where I did not have an account - who cashed the check for him without proper ID check.
Absolutely nothing was done even though they knew who was involved and one worked at the bank!
It would "cost them too much to prosecute".
Same for card theft.

Now I believe that this problem of card theft would decrease if the companies would prosecute, regardless of the amount. It would likely even save them money in the long run. That it'd cost most to prosecute than the amount stolen - the attitude today - is wrong IMHO. I'd discuss it further, but it might skirt on NYC politics, so I'll avoid.
