The words aren't clear but the fury is.
I got really mad here once, John, and lost a lot of sleep over it. I guarantee you I'm not the least bit angry now, just amused. Lessig rejected the Critical Legal Studies theory, but from what I know of how our government works, it works often enough.
Why, exactly, do you think Microsoft's legal position is airtight and sure to prevail? I'm not a lawyer. I have in-house counsel, but she's mighty annoyed that I spend time arguing here when I should be getting to bed. The only admitted lawyer here says antitrust is a complex matter, and anybody who thinks they understand it all is deluding themselves. On that count, at least, I have no delusions.
Oh, and remember, Lessig held his own at the Chicago School, even if he didn't toe the line on certain matters of legal philosophy. Clerked for Scalia, too, so it's hard to see him as a fuzzy headed liberal. I'd give his words a lot more weight on issues of the law than I'd give yours, or the resident antitrust expert.
