It appears as if MSFT has a pretty good point with the judge unilaterally expanding the scope of the hearing outside that of the plaintiff's actual motion/petition. This seems especially significant given the fact that the defendant as not given an oppurtunity to rebutt, respond, or reply prior to the judges order. MSFT's argument seems even stronger given the fact that we have not heard a peep out of the DOJ concerning their opinion on the matter.
