A valid FS exists but a BFS, as defined by and IAW Salazar, does not. I'm assuming the key from a legal perspective was the fact that the Feasibility Notice was not served. I recall posters reporting questions put to CUU about the 120 day clock but never about the FN. I pointed out the requirement for the FN on February 4, 2013, but was ignored. Looking back I should have said "delivery of a copy" but confusion reigned supreme at that time : agoracom.com

Without the FN my understanding is the contract terms and conditions were in a state of limbo until the JV was announced, as I and others learned in hindsight.
