If you look at the legal battles between AAPL and SAMSUNG, the only question I have is in what year/decade?

The way I'm reading this is that since Samsung agreed to pushing back interest payments by the Schneider subsidiary until Jan, 2016, it's almost a tacit admission by Samsung that they are in default on the operational availability of Zephyr.

So not only will Samsung NOT receive interest payments if they can't bring it back up to 96% availability in order for Zephyr to fulfill it's power generation obligations to their customers, it will have to provide compensation (presumably the lost deficit amount)..

I've been waiting for a long time to see this albatross (from prior management) lifted from around Quantum's neck as they return to core business.

So, as long as Quantum has no financial outlay while this matter is in dispute, and there is the potential of Samsung being required to take over the operation if it cannot resolve it's operational default status, AND revenues are received from compensation that equate to close to the 96% availability as Q has to buy power to make up for it's deficit to existing contracted customers, I think I'm ok with it.

And since Zephyr is up for sale as a discontinued operation, I believe it's been pretty much written off by Q (need hard confirmation on that), and any impairment towards selling Zephyr because it's not up 96% of the time, may be cause for further compensation in the future.

I think Samsung might want to take it over because of the liabilities..
