He still had the ability to breath until he was in the van. He had his neck broken .. then abused in the van until the bones sawed through 80% of his spinal cord. He was able to breath before. By the time he got out of the van he could not breath by himself. He was in that van for 20 minuets. Obviously he was breathing some of that time. It was the continued abuse of the person AFTER his neck was broken that killed him.
