It's simple. To get you INTO custody, it is proper to stop someone. By whatever means necessary.

Once you are in the physical control of the police, they no longer have the ability to use deadly force.

If the suspect gets out of the control of the police, back to deadly force.

POLICE CAN NOT PICK YOU UP AND KILL YOU. They might pull off killing you while attempting an arrest, but once the police have physical control, deadly force needs to end.

I don't think it's that cut and dried.

If they are allowed to kill you after arresting you, there is zero reason to be polite about it. Police abuse of the public is the reason for the second amendment.

There is no reason to surrender, if they're going to kill you anyway.

In this case it is possible that they mistook a seizure for an attempt to fight.
