KG,

It is possible for them to use "ZIP", or any other registered Trademark, depending on how they use it. They cannot use a term like "compatible with" or "equal to"... without IOM's agreement. But, just as Burger King talks about "The Big MAC" and McDonalds talks about "The Whopper", Nomai can use a skillfully and legally phrased vague wording in their advertising.. Something like "comparable to Iomega ZIP".. leaving the consumer to draw his/her own conclusion about the comparison. Trademarks allow a fair use, when the currently registered trademark owner is credited and acknowledged in the usage.
Microsoft ran into this back when they thought they could control the world's use of the generic word window or windows in almost any context... it was held they couldn't.
