The 150 emails were classified after the fact because they were found to contain confidential information. Hillary can state with certainty they had not been marked as classified. She can not state convincingly that she did not know there was confidential information in them. But we cannot prove she did not know there was confidential information in them or we could hold her liable.

Of course her emails couldn't be marked classified before she created them so it is something of a loop hole anyway.
