But we cannot prove she did not know there was confidential information in them or we could hold her liable.

Another one of your word games. 'Confidential' is a classification. One step below 'Top Secret'. The information in the emails was not classified 'confidential' at the time the emails were sent. At least according to the State Department. Logically speaking, that means they were classified 'confidential' at some later point in time by another department. Short of a time machine, there was no way she could have known that the information would be later classified.

Period. End of game.
