Seems like there was some shared responsibility. I don't condone DUI, but operating without lights at night you are asking for trouble.

I grew up on a lake boating on since I was 7yo. I've watched two friends of mine get hit on a Laser sailboat in broad daylight and my neighbor's daughter was run over while in a 13'4" Boston Whaler by a 18' Runabout at night, she had her lights on.

Judge Carol Scharpira teared up, and as she imposed a sentence of two and a half years, which is half of what the prosecution wanted because the people on the sailboat were intoxicated and their boat didn't have lights on in the dark.
