The VW engine CPU would necessarily need to pass all emissions tests while idling, in addition to activating the special 2-wheel-only mode for dynamometer testing.

No consumer is going to notice reduced diesel engine performance while idling. The VW cheat is designed to provide better mileage and better engine performance while driving by violating air quality standards.

The EPA requires all vehicle manufacturers to submit their new model vehicles to the EPA for dynamometer emissions tests before they can be approved for sold in the United States. The dynamometer tests include a simulated city test pattern and a simulated highway test while also measuring gas mileage.

These EPA emissions approval tests are not related to any emissions testing consumers may be subsequently required to perform periodically in their county or state of residence.

It has become less common for vehicle makers to produce different models specifically for the California market, so I suspect California now contracts the EPA to perform this same testing on any California specific models.

California also uses dynamometer testing for semi-annual post-sale licensing, and the VW engine CPU also permits these diesel cars to falsely pass these semi-annual tests as well as the CPU senses only two of the four wheels are moving.
