If you read what the judge said, he indicated that he wanted evidence from both sides -- DOJ *and* MSFT as to whether the "uninstall" he performed was really an uninstall or not. Although I have no basis for judging it on a legal basis, it does seem like he should have gone about it in a different way. As it is, it looks like some sort of publicity stunt.
