Yes. SmithKline has probably been misled by TXB. However; I have seen situation in the past where a big pharm may have cheap stock in a development stage company, and will simply cash out quietly. I have also seen the majority of these licensing agreements simply go up in smoke. The big pharms do many of these types of arrangements every year. The vast majority are losers.

The FDA has nothing to do with this one way or the other.
