If Apricus have exchanged more shares for cash under the existing Aspire deal to shore up the finances, do they need to declare that when it happens, or can they just wait until they issue the earnings report next month?

No, they need not make it public when it happens ( for any sale of shares to Aspire ). That requirement was satisfied with the Original Sec filing. In other words, we all know it can happen at any time. And yes, we would have to wait until the 10Q or until the 10K ( if they have not sold any shares during July 01, 2015 - September 30, 2015 ).

My opinion on this matter is that - if in fact Apricus sold shares after October 01, 2015 to Aspire - they would probably let us know during this Conference Call ( either mentioned during the C.C. or mentioned in the 10 Q or both ).

My gut feeling though on the financing issue is that we will have either a Private placement or we will issue Convertible notes. Something from left field! All retail have been on edge regarding the financing - it has been like a really really slow pitch that has taken it's time to reach the plate. Everybody knows we are running out of money and need money. There will be a twist on this one. Everybody is expecting a Secondary at lower prices.

Will should know - no later than February 2016 - My Opinion!!
