Actually, their false release yesterday was very encouraging to me as a short because the company's desperation is showing.
Looks to me a lose-lose situation for them by Jan 15:

-If the shareholders approve the merger, the stock gets diluted by 17% and will fall down at least 2-3 points from here.
-If the shareholders do not approve the merger, the stock falls like a rock because no body is willing to show confidence in the compnay.

And these interpretations are not considering Judge Whyte's ruling on Acquarius in the mean time that could change the situation quite a bit.
What are some of the losing scenarios for shorts in the meanwhile?
I doubt that the injunction against Acquarius (which could be a losing scenario) will not come because that would be apparent by now also I doubt if anyone would want to buy them.
