That idea goes back even further. Look up Wickard vs Filburn.

It wasn't really the creation of law, it upheld an existing law. But the Supreme Court really fell down on its job of enforcing the constitution with that case. Growing wheat for consumption by animals on your own farm is "interstate commerce".
