"If that is the case, he should have never went public with an unscientific, undocumented experiment that went against the favor of MSFT. He definitely should not have commented on it."

It was my impression this experiment was demonstrated to the Judge in his courtroom where everything is a "matter of record"; public record no less. Being a Windows fan maybe the concept of an open environment seems foreign or alien to you.
