SYDNEY, AUSTRALIA, Newsbytes via Individual Inc. : US-based chipmaking giant Intel Corp.[NASDAQ:INTC] has launched legal action against Australian retailers which it claims have been involved in the import and redistribution of " remarked" Intel microprocessors, according to The Australian Financial Review.
The action was launched in the Australian Federal Court last Friday, when Intel sought an order stopping distribution of the processors.
"Remarked" chips are said to be manufactured by Intel to work at a particular clock speed, but are sold -- without Intel's permission -- running at a higher speed.
According to an Intel statement, the remarked chips could overheat and be damaged if run at the higher speed. The company says its warranties would not apply to remarked processors.
Intel has named a Melbourne-based computer dealer, Computer Touch Ltd., as involved in the transactions. A Computer Touch director, Tony Chau, said the company was not responsible for any remarking.
A lawyer for the company said issues to be contested included whether the chips involved were indeed remarked. _____________________________________________________________________
