Actually that's not in the constitution. Its in the Declaration of Independence.

Capitalism places "freedom" above equality; one might argue that communism attempts the opposite.

"Democratic Socialism" attempts to maximize both. It builds on what the Declaration calls life, liberty and the pursuit of happiness. I don't think that capitalists sees happiness as a right - obviously it is seen, like all of value, determined in free markets for individuals, through supply and demand.

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."
