If you want to "evolve" the constitution, amend it.
Or just get five liberal justices to interpret the Constitution any way they feel like.

To this day, I still can't figure out how the 4th amendment can be construed in a way that legalizes abortion. Yet every liberal blindly accepts the notion that abortion is a right guaranteed by the Constitution.

Same liberals, of course, want to strictly interpret the "well-regulated militia" clause of the 2nd amendment.

Those are the consequences of turning the Constitution into a "living, breathing" document that's open to "evolution" outside of the amendment process.
