I'm talking about practical reality. An email you haven't seen when you are Secretary of State must be presumed classified because its status cannot be determined until you have seen it.

You understand that under the law a document not marked as classified may well be classified anyway? And that it being unmarked has NO BEARING, WHATSOEVER, on whether the document is classified and whether the recipient is legally obligated to handle it as such, right?

Her ignorance would not excuse her mishandling.
