And if there really was any such duty (which is a silly idea), if the idea somehow created massive pressure for a vote, the nominee could just be rejected quickly, while if Obama tried to place Garland in office by himself he would face the outright opposition of both of the other branches of government (I know the court is 4-4 right now but even the liberals wouldn't go along with that kind of crap, and also while Roberts has no more power as a judge then the other justices he has administrative authority that is relevant here).

This isn't the first case under Obama where the left tried to argue that congress had a constitutional duty to act the way they want it to act. Its seems it gets more ridiculous each time.
