Apparently you are incorrect, as CFIUS just recently exerted influence at a proposed 15% stake, in the case of a proposed 15% stake in Western Digital by Unisplendour.

And Treasury regulations specifically state there is no automatic exclusion from applicable rules for acquisitions of ten percent or less. Only passive investments under 10% are excluded. And that exclusion terminates if passive intent is not maintained, or actions to the contrary are taken. I suggest you review 31 CFR Part 800 for a refresher on the applicable regulations.

Its very easy to throw out accusations of nefarious activity by others, but in the end facts are needed to support such assertions. You have none.
