The employees who sign the contract has rights under it, rights pertaining to the counterpart in the negotiation, the company. Not against other potential employees who don't want to join the club that negotiated the agreement. Also those rights aren't property rights, but contract rights. If there was a violation of the contract it wouldn't be a seizure it would be a breech of contract. The third party (new potential employee who doesn't want to join the union) didn't sign a contract with the union.
