At least in the part of the biopsy that was tested. Maybe they are positive in other parts of the tumor, or were positive at one earlier stage of their disease or maybe they are truly not positive for ALK. But that would then be puzzling that they got some response - this isn't like PD1 where you could expect at least some level of response for everyone.

Be interesting if they did one of the new liquid tests on the stored blood.
