What do you mean Xinex has to buy the VCC's shares? Are you a lawyer making a legal statement? Why don't they buy your shares too at a higher price? Xinex is dealing with the VCC's frustations by defending itself in court. If we did not have this lawsuit everybody would look at the recent good news in a different light. Should the lawsuit be dismissed, the VCC guys will really have help their cause and the company's shareholders' !!! I am sure Helix received all the necessary legal opinions on this lawsuit before putting more money in. Haven't read any legal opinion on this thread. Your guess is as good as mine but I believe Helix' guess is more educated than yours and mine.

As far as the product is concerned the jury's out. Just happen to think that it will sell. The company is on schedule on its marketing plan. There are two types of technology investments: i) at the early stage before you can quantify precisely the potential return and ii) at a later stage when you make it an earnings play. Money can be made or lost either way. I kind a prefer the former. I don't know about you?

The VCC guys want out period. They just choose the least effective way to achieve their goal. The took a BIG bet. If their action is dismissed they will only have succeeded in diminishing the value of their investment (and everybody else's) by 60%. Give us all a break Ruby, Mr. Leahy has done a fantastic job with this company. He does need to work at XNX. He could get a job anywhere tomorrow. If he is sticking around through all this with the little amount of stock he owns it means he believes in the company. And coming from a guy like him it means a lot.

My bet for 1998? Lawsuit gets resolved, VCC gets taken out and the company keeps delivering. I HOPE EVERYBODY ON THIS THREAD GOES BACK TO TALKING ABOUT WHAT IS HAPPENING INTERNALLY AT XNX. If people still want to speculate on the reasons of and potential outcome of the lawsuit, let's get a lawyer in here.
