Not defrauding anyone anymore != will not be convicted.

1 - You can get convicted on other charges.
2 - You can get convicted for your previous acts of fraud.
3 - You can get convicted for fraud even if you are not defrauding anyone any more.

From your link it seems like its largely a combination of #2, and convicting them for making statements downplaying the harm from tobacco. Its a stretch to call that fraud since with every sale there were warnings about the harm, but prosecutors stretch the law all the time.
