What got the tobacco companies in trouble was that, despite the information that they had for decades, they claimed the information was wrong or inconclusive well beyond the time it was conclusively proven. And, as a result, they benefited economically because of it. Likewise, the fossil fuel companies are making claims and paying others to make claims that have been proven false. It isn't a matter of opinion, it is a matter of fact. Their sole reason for doing this is to make more money than they would if they were behaving responsibly. And that is fraud. If they weren't making money from it, it wouldn't be fraud.
