No they aren't. If you are promulgating false information that results in an economic gain for you, that is fraud. By definition. Always has been.

By your definition, scamming the elderly out of their life savings by providing them with false information is legal. But it isn't. Likewise, your claims of being a Nigerian prince who needs access to your bank account to move some money for which you will be richly rewarded isn't legal either.

Fraud is not free speech. Nor should it be. If you think it should be, well that says a lot more about your morality than you probably think it should.
