I don't know what "media" was suggesting that you can prosecute (I am assuming you mean in the criminal sense) for "gross negligence"...you'll have to post a link.
Common sense dictates that "extreme carelessness" (which Comey accused Clinton of) isn't much different from "gross negligence." Even Wikipedia defines gross negligence as "serious carelessness."
