This case was mentioned on Fox as a precedent, but it was dismissed (and even Comey mentioned this after Fox brought it up) because in fact the fellow was never charged.
The Marine was dismissed as unfit for duty after the incident. Funny how that works, given that Hillary now gets intelligence briefings as a presidential candidate (the same briefings that the Democrats want to prevent Trump from getting).

However, upon further review, I do take back what I said about a normal person being criminally charged for gross negligence when it comes to the handling of classified info. Apparently when it comes to criminal charges, intent does matter, as it is hard to prosecute even though gross negligence technically doesn't require intent.

But that still makes Hillary a slimeball, given that it's clear to me that she intentionally skirted the requirements for FOIA information retention.

All she had to do to avoid criminal charges is say, "Oh, I didn't know, I didn't intend to break the law." It's pure bullshit, but it works. Just like her husband avoided perjury charges by saying, "Oh, I didn't know oral sex is sex" or "That all depends on what your definition of 'is' is."
