Apparently when it comes to criminal charges, intent does matter, as it is hard to prosecute even though gross negligence technically doesn't require intent.

You don't know any of that "clear" stuff either...it could have been something she didn't even give any thought to, just as Powell and Rice before her...the fact is that all but three email were found to have the small (c) marking on them, buried in the email chain, and two, the state department now tells us, were left there by staff error, after they were supposed to have been declassified...the rest were classified after the fact.
