If you asked your broker to exercise before the due date and he didn't, I would call his manager and rgister a complaint. Since the shares subsequently went up and your warants died worthless, it seems to me they owe you the damages. Don't be shy about running it up to higher levels or requesting arbitration. They will likely settle rather than go to arbtration if they failed to execute your instructions.
