My only problem with that is that when you let individual owners decide no one wants to go first, so everyone allows smoking. The restaurants I worked in had non-smoking sections but that was meaningless. The air was full of smoke everywhere. And it was awful. Now you could argue that the non-smoking diners didn't HAVE to eat out, but why? They aren't engaging in any activity, except dining, which is afterall what restaurants are for. Smokers, on the other hand, are actively doing something that is superfluous to the dining experience. I find dancing on the table naked after a meal, makes dining much more enjoyable, but I'm not allowed to do that at restaurants (at least not the kind I want to go to.)
