As I recall abortion was illegal in every state in the country. It was legal in some states prior to Roe. If the Supreme Court says that abortion is illegal Why would the Court do that? The Court deals with cases brought before it. It doesn't make law. All it might do would be to quit supporting its opinion in Roe that there's a privacy right to abortion by no longer overturning state limits on abortion like it did in the recent Texas case. That would leave a void for the states to fill or not fill.
