As the Ninth Circuit reiterated, “we defer to the political branches in the immigration field.” Ruiz-Diaz v. United States, 703 F.3d 483 (9th Cir. 2012).

Ninth Circuit has said briefing to be done on Monday for hearing on a stay of the order. We'll see if the circuit listens to itself.

My concern is that Gorsuch isn't on SCOTUS yet. If the merits of this goes to the Supreme Court too fast, it will be a tie and we lose at the Ninth Circuit.

This is just for the stay, not the ultimate merits of the constitutionality of the EO. But allowing the stay to stand pending that lets a lot of bad actors in while they know it is possibly their last chance.
