The issue can be settled the way it always was before "big brother" started trying to protect everyone from themself: amicably between individuals.

If an airline wants to have a smokers only division what right does the federal government have to say "NO" (as they did a few years back to an airline in Texas). If a restaurant owner wants to allow smoking in his restaurant and some people fear the "effects" of second-hand smoke, those non-smokers DO NOT have a lien on the rights of the owner of the restaurant who created the establishment in the first place. The non-smokers can vote with their pocketbook and not patronize the restaurant.

What I am saying is "government has no right, nor legal authority, to legislate away any individual's free choice".
