The IPMCF release refers to the results as the "independent laboratory results." Does that mean they are COC results, I don't know, I haven't been following it closely, just ran by the article on Yahoo. As Henry commented, whether COC or not, they probably are not commercially viable. They have yet to come up with a good assay technique let alone a feasible recovery method. If they have the goods, J-L should be of use to them once they have the foresight to seek their assistance (with Naxos reaping the royalty benefits of course).
Larry, thanks for the info. While Max points out gaps, the gist of the information sounds reasonable enough. I certainly expect certified results to be released before the ASC hearing (I hope they don't have to wait till the middle of that hearing, which I understand may take about three weeks -- I understand it begins on January 12). Also, I believe the issues that are going to be addressed at the hearing, as unfortunate as that is, are practically the same as those that the ASE dropped as part of its settlement with Naxos, plus the insider trading matters.
